This disclaimer (“Disclaimer”) applies to all services provided by Arkie Media, LLC (“Arkie Media”) to its clients (“Client”).

The services provided by Arkie Media, LLC, a web design and development agency, are provided on an “as is” basis. We make no warranties, either expressed or implied, regarding the services provided. Furthermore, we do not guarantee that any specific results will be achieved through our services. We cannot absolutely guarantee the success of any new marketing strategies that are developed.

We are not responsible for any lost or stolen data or any lost profits that may result from our services. The client is responsible for any risks associated with our services. We reserve the right to make changes to our services without prior notice.

Arkie Media and the Client agree that neither Arkie Media nor the Client shall be held liable for any delay or default in fulfilling its obligations under this Agreement, caused by fire, riot, acts of God, or war, where such cause was beyond, respectively, The Client or Arkie Media’s reasonable control. Arkie Media shall, however, make all reasonable efforts to remove or eliminate such a cause of delay or default and shall, upon cessation of the cause, diligently pursue performance of its obligations under this Agreement.

Domain Names
Arkie Media is not responsible for any domain name(s) registered and/or owned by the client. All domain name(s) remain the full responsibility of the client to stay up to date and abide by all applicable domain name(s) laws. Arkie Media is not responsible for any fees related to the renewal and/or transfer of any domain name(s). The client is fully responsible for any and all fees associated with the domain name(s). Arkie Media is not responsible or liable for any damages, losses, or expenses related to the domain name(s) or to any content or data associated with the domain name(s). The client holds all risk and liability related to the domain name(s) now and in the future. Arkie Media will not be responsible for any unauthorized transfer, renewal, or other action related to the domain name(s) taken by any third-party. The client is solely responsible for taking the necessary steps to protect the domain name(s) from any unauthorized access or use.
